2. Description of Service
WhiskAI is an AI-powered cooking platform featuring Curie, a personal cooking assistant. The Service provides recipe discovery, generation, and personalization; meal planning; shopping list creation; and grocery store discovery. The Service is available via web application and mobile application.
3. User Accounts
To use the Service, you must create an account using a valid email address or a supported third-party sign-in provider (Google or Apple). You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
You agree to:
- Provide accurate and complete information when creating your account
- Keep your login credentials secure and confidential
- Notify us immediately of any unauthorized use of your account
- Accept responsibility for all activity under your account
4. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Attempt to gain unauthorized access to any part of the Service
- Interfere with or disrupt the Service or its infrastructure
- Use automated means to access the Service without our permission
- Impersonate any person or entity
- Upload or transmit malicious code or content
5. AI-Generated Content Disclaimer
Curie, our AI cooking assistant, generates recipes, meal plans, nutritional information, and other content using artificial intelligence. While we strive for accuracy, you acknowledge and agree that:
- Not medical or dietary advice. AI-generated content is for informational and entertainment purposes only. It does not constitute medical, nutritional, or dietary advice.
- Allergen awareness is your responsibility. Always verify ingredients against your known allergies and dietary restrictions. Curie may not identify every potential allergen.
- Accuracy is not guaranteed. AI-generated recipes, cooking times, temperatures, and nutritional information may contain errors. Use your judgment and established food safety practices.
- Consult professionals. For specific dietary needs, medical conditions, or food allergies, consult a qualified healthcare provider or nutritionist.
6. Intellectual Property
The Service, including its design, features, and underlying technology, is owned by WhiskAI and protected by applicable intellectual property laws.
Your content: You retain ownership of any original content you create or upload to the Service (such as personal recipes or photos). By using the Service, you grant us a limited license to store, display, and process your content solely to provide the Service to you.
AI-generated content: Recipes and other content generated by Curie for you may be used freely for your personal purposes.
7. Limitation of Liability
To the fullest extent permitted by law, WhiskAI and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Service.
This includes, without limitation, any damages resulting from reliance on AI-generated content, recipes, or nutritional information. WhiskAI's total liability for any claim arising from your use of the Service shall not exceed the amount you have paid to WhiskAI, if any, in the twelve months preceding the claim.
8. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.
9. Termination
You may delete your account at any time. We reserve the right to suspend or terminate your access to the Service at our discretion, with or without notice, for conduct that we believe violates these Terms or is harmful to other users or the Service.
Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (such as limitations of liability and intellectual property provisions) will remain in effect.
10. Modifications to Service
WhiskAI reserves the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuance of the Service.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved in the appropriate courts.
